Special Terms for Mainland China Users
Effective Date: May 14, 2026
These Special Terms for Mainland China Users apply to users, customers, developers, enterprise customers, and other parties located in Mainland China, or acting for Mainland China entities, who access or use OmniRouters through the website, console, APIs, SDKs, plugins, or any related service channel.
These special terms supplement the Terms of Service and the Privacy Policy. If there is any inconsistency between these special terms and those documents with respect to Mainland China users, Mainland China data processing, cross-border data handling, or overseas model access, these special terms will prevail.
1. Scope and Important Notice
- OmniRouters is operated by a Hong Kong entity, but that fact does not automatically exclude the application of Mainland China laws, regulations, and regulatory requirements to relevant service scenarios.
- If you are located in Mainland China, or if you use OmniRouters on behalf of a Mainland China organization, customer, project, or end user, you must independently assess and continuously comply with applicable Mainland China laws, regulations, industry rules, regulatory requirements, and local guidance.
- If you integrate OmniRouters into an application, website, platform, mini program, plugin, enterprise product, or other service that is made available to the public in Mainland China, you should carefully assess obligations relating to generative AI, deep synthesis, algorithm filing, content governance, cross-border data transfer, personal information protection, industry licensing, and business qualifications.
2. Notice Regarding Overseas Models and Cross-Border Processing
- Depending on the model, routing policy, capability type, or infrastructure configuration you choose, OmniRouters may transmit your requests, prompts, conversation context, uploaded files, audio, images, videos, metadata, or related outputs to model providers, cloud providers, infrastructure providers, or other partners located outside Mainland China for processing.
- As a result, your data, data you submit on behalf of others, and related outputs may be stored, transferred, cached, processed, analyzed, or called outside Mainland China.
- You must ensure that you have the right to submit the relevant data to OmniRouters and to authorize OmniRouters to further transfer that data to relevant overseas recipients for processing.
- For requests involving personal information, sensitive personal information, business data, log data, files, recordings, images, videos, facial data, voice data, biometric information, or other regulated data connected to Mainland China, you are responsible for determining whether the processing constitutes the provision of personal information outside Mainland China or any other regulated cross-border data activity.
3. User Representations and Warranties
By using OmniRouters, you represent and warrant that:
- the data and content you submit, upload, transmit, call, or process are not data that is legally prohibited from being transferred abroad and do not include data you are not authorized to process;
- for any personal information, sensitive personal information, facial data, voice data, recordings, images, videos, credentials, business files, or other data that may affect individual rights, you have obtained the required lawful basis, authorization, consent, separate consent, or other necessary approval;
- you will not use OmniRouters to process state secrets, confidential government information, important data, core data, or other data that may not lawfully be transferred, stored, or processed outside Mainland China;
- you have completed any necessary internal data classification, data protection review, personal information impact assessment, customer authorization process, or contractual arrangement required for your scenario;
- if you act on behalf of an enterprise, institution, or customer, you are authorized to accept these terms for that party and to ensure that your end users, employees, customers, or partners have been properly informed of relevant data processing arrangements.
4. Special Responsibilities for Services Made Available to the Public in Mainland China
If you build, operate, or provide an application or feature to the public in Mainland China based on OmniRouters capabilities, you are solely responsible for assessing and fulfilling all legal and regulatory obligations relating to that application or feature, including:
- assessing whether your service constitutes a generative AI service, deep synthesis service, algorithm recommendation service, or other regulated internet information service made available to the public in Mainland China;
- assessing and completing any applicable filing, registration, security assessment, conspicuous labeling, public disclosure, complaint handling, content review, log retention, real-name verification, industry licensing, or other legal obligation;
- publicly displaying, where required, the model name, filing number, registration number, or other regulatory information associated with the filed or registered model or service you rely on;
- implementing your own terms, privacy notices, content governance rules, complaint channel, incident handling process, and account management rules appropriate to your product and audience;
- taking responsibility for how your end users generate, edit, publish, distribute, export, or further use content produced through your integrated experience.
OmniRouters does not guarantee that any product, feature, API integration, plugin, or downstream service you build for the public in Mainland China automatically satisfies Mainland China regulatory requirements.
5. Content Compliance and Use Restrictions
You may not use OmniRouters to:
- generate, reproduce, publish, or distribute content prohibited by Mainland China laws or regulations, or other unlawful or harmful content;
- engage in regulatory evasion, false promotion, unlawful news dissemination, political manipulation, public opinion manipulation, social mobilization, fraud, unlawful securities promotion, unlawful medical guidance, infringing marketing, content laundering, bulk deception, or malicious impersonation;
- process or generate facial data, voice data, identity-linked content, minors' information, biometric information, or other highly sensitive content without sufficient authorization or where legal requirements are not met;
- remove, alter, bypass, or conceal any legally required labels, watermarks, logs, notices, or compliance controls for generated or edited content;
- rely on OmniRouters outputs as the sole or primary basis for decisions in high-risk scenarios, including healthcare, legal advice, finance, credit, employment, education evaluation, public administration, or any other context that may materially affect individual rights.
6. Internal Enterprise Use and Downstream Integration
- If your use is limited to internal research, testing, evaluation, demonstration, prototyping, or internal workplace assistance and is not made available to the public in Mainland China, your regulatory profile may differ from a public-facing service. This does not remove your obligations relating to data security, personal information protection, confidentiality, trade secrets, and sector-specific compliance.
- If you integrate OmniRouters into a customer project, SaaS product, workflow platform, automation tool, plugin marketplace listing, app store product, or other third-party delivery scenario, you are responsible for ensuring that the downstream delivery model and downstream users have an appropriate compliance basis.
7. Data Export and Personal Information Cooperation Obligations
If OmniRouters reasonably believes that your integration, data type, data volume, user geography, application scenario, or model usage pattern may create elevated cross-border data or Mainland China regulatory risk, OmniRouters may require additional information or cooperation, including:
- your legal entity identity, business scenario, end-user scope, and geographic coverage;
- your data-type description, classification outcome, and sensitivity assessment;
- your personal information notice and consent mechanism;
- your contractual or authorization basis with end customers, data subjects, or partners;
- whether you have completed or intend to complete any assessment, contract, certification, filing, registration, disclosure, or other compliance measure.
If you fail to provide sufficient information, or if OmniRouters reasonably determines that the relevant risk is unacceptable, OmniRouters may limit, suspend, refuse to enable, or terminate the relevant models, APIs, regional access, file uploads, media generation capabilities, or other services.
8. Model Availability and Regional Restrictions
OmniRouters may at any time impose restrictions on specific models, capabilities, regions, features, file types, output forms, or access methods based on law, regulation, regulatory requirements, partner policy, technical risk, content safety, cross-border data risk, or commercial arrangements, including:
- hiding, disabling, or withdrawing specific overseas models for Mainland China users;
- restricting high-risk capabilities such as image, video, speech, music, digital human, voice cloning, or face editing functions;
- requiring whitelisting, enterprise contracting, separate approval, or manual review for certain customers;
- requiring additional human review, purpose declarations, logging obligations, or user confirmations for certain generation scenarios.
9. Breach Handling and Allocation of Responsibility
If you violate these special terms, applicable laws, or regulatory requirements, or if OmniRouters reasonably believes that your use may create legal, regulatory, security, reputational, or commercial risk for OmniRouters, its partners, other users, or third parties, OmniRouters may take one or more actions, including:
- rejecting requests;
- limiting model, capability, region, or API access;
- requiring remediation, supporting materials, or suspension of the relevant business;
- freezing, suspending, terminating, or banning an account or API key;
- cooperating with regulators, courts, law enforcement, or partners on further action where required.
If your violation of these terms causes OmniRouters, its affiliates, or its partners to suffer complaints, investigations, penalties, claims, takedowns, model suspension, service interruptions, or other losses, you must bear the corresponding responsibility and compensate the resulting reasonable losses and expenses.
10. No Legal Advice
The publication of these special terms, the provision of APIs, model routing, documentation, or any compliance-related communication by OmniRouters does not constitute formal legal advice, a regulatory determination, a filing conclusion, a data export conclusion, or a compliance guarantee under Mainland China law.
If your business involves the public in Mainland China, government or enterprise customers, regulated sectors such as education, healthcare, or finance, cross-border personal information processing, large-scale content generation, media publishing, human-like interaction, deep synthesis, or other high-risk scenarios, you should obtain formal advice from qualified Mainland China legal counsel, data compliance advisors, or a dedicated compliance team before launch.
